I understand that the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. I further understand that COVID-19 is extremely contagious and is believed to spread by person-to-person contact and possibly by contact with contaminated surfaces and objects or in the air; and, as a result, federal and state health agencies recommend social distancing. People reportedly can be infected and show no symptoms and therefore spread the disease. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
Assumption of Risk
I recognize that Golf Lounge 18 is closely monitoring this situation and have put in place reasonable preventative measures aimed to reduce the spread of COVID-19 at all of their locations. However, given the nature of the virus, Golf Lounge 18 cannot guarantee that you will not become infected with COVID-19. And, you recognize that while playing, taking lessons or participating in an event at Golf Lounge 18 could increase your risk of contracting COVID-19. It is not possible to prevent against the presence of the disease.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while playing, taking lessons or participating in an event at Golf Lounge 18 and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Golf Lounge 18 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, other Golf Lounge 18 employees, owners of Golf Lounge 18, and the customers of Golf Lounge 18 and their families.
Waiver of Lawsuit/Liability
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur during my presence at Golf Lounge 18. I hereby release, covenant not to sue, discharge, and hold harmless the Golf Lounge 18, its owners, other employees, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Golf Lounge 18, its owners, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participating in any activity at the Golf Lounge 18
